Terms & Conditions

The Company - PWS Tech Services under the Trade Name - Selfdrive.in will be officially Interpreted/titled as Selfdrive for this agreement. This instrument is a contract and governs the legal relationship between Selfdrive and the Hirer/Renter.The terms and conditions below govern your use of and access to Selfdrive's service and contain conditions, limitations and exclusions that might apply to you. Please read them carefully and keep them safe for your future reference.

Definitions

  1. SelfDrive: Refers to the provider of car rental services through the mobile application and e-commerce platform, along with associated services.
  2. Hirer: Represents individuals or entities (renters, drivers, customers, clients, lessors, etc.) that use SelfDrive's services to rent a vehicle on a daily, weekly, monthly, or yearly (lease) basis, and are bound by the terms and conditions stated herein.
  3. Booking / Reservation : A booking made by the Hirer using the SelfDrive mobile application (iOS | Android | Mobile Site | Progressive Web Application (PWA)) or platform, subject to successful payment confirmation.
  4. Booking Confirmation: An electronic communication (e-ticket) issued to the Hirer by SelfDrive upon successful booking and payment confirmation, detailing all relevant booking information and agreed-upon terms.
  5. Partner/Affiliate Partners: Refers to companies or organizations, including car dealerships, leasing, or rental companies, that supply vehicles to the Hirer and are the beneficial owners of those vehicles.
  6. Rental Agreement/Lease Agreement: The contract between the Hirer and the Partner for the vehicle provided during the rental period, which is executed during the vehicle handover.
  7. Vehicle: Refers to the car or any other vehicle rented by the Hirer pursuant to a booking, including its parts, components, accessories, and contents supplied by SelfDrive or its affiliate partners.
  8. Kilometers Allowance: The permissible kilometers allowed per day (Daily & Weekly) or per month for Monthly, Micro-lease, and Lease-Pro bookings during the rental period, as agreed upon and accepted during the booking process.
  9. Excess KM: Any additional kilometers driven beyond the permissible kilometers agreed upon during booking confirmation, applicable during the rental period or in cases of early termination.
  10. Early Termination: The event in which the Hirer terminates the contract before the actual end date, subject to early termination charges.
  11. Early Termination Charge: The penalty incurred by the Hirer due to the event of terminating the contract prior to the actual end date.

1. Insurance

Comprehensive insurance is provided in accordance with current Indian law. The Hirer is liable for the actual cost of any damage, including service charges (which vary by car category), for each accident, including hit-and-run incidents, provided there is a police report for at-fault claims. This liability can be waived by purchasing the Super Collision Damage Waiver (SCDW), if applicable and offered by SelfDrive and its partners. The Hirer must not engage in any activities that would invalidate the insurance or increase its cost regarding the vehicle. In the event of a breach of this clause, the Hirer will be liable for all loss, damage, costs, and expenses arising from such actions. The Hirer will also refrain from actions that may prejudice any warranty or maintenance contract issued by the vehicle manufacturer.

2. Kilometers Allowance

The kilometers are limited to 100 km per day for Daily & Weekly rentals and between 1,500 km to 2,500 km per month, depending on the car selected (refer to the e-ticket for exact details). For the Price Lock Option (bookings longer than 1 month), the allowance will be 1,500 km to 2,500 km per month. The Hirer agrees to remain within the agreed and permitted kilometers as specified in the booking confirmation. If the Hirer exceeds the agreed kilometers, an additional charge of up to ₹500 per kilometer will apply, based on the car model (see the e-ticket for specific details). In case of early return, excess kilometers will be charged based on the duration of the return, according to the allowed kilometers.

3. Maintenance

Maintenance includes routine servicing at every 1,500 km (first service), oil changes every 5,000 km, and major servicing every 10,000 km or every six months, whichever comes first. All vehicles require servicing at regular intervals of 12,000 km or every 2 years unless a service warning is issued by the car. It is the Hirer's responsibility to request servicing through the appropriate channels. Any delay in requesting servicing that leads to damage or breach of warranty will be the Hirer's liability. The customer must not have the vehicle serviced, maintained, or repaired by any third parties.

4. Replacement Vehicle/s

In the event of routine service (with downtime exceeding 24 hours), maintenance, or breakdown, a replacement vehicle of similar category and amenities will be provided at no extra cost, subject to availability. The company reserves the right to recall the rented vehicle from the Hirer due to the vehicle reaching its end of service, expired warranty, expired vehicle license/plate registration/insurance, or any other condition that renders the vehicle non-drivable (or if a recall has been requested by the manufacturer). In such cases, SelfDrive and its partners will offer an alternative option to maintain the basic level of service. If the Hirer refuses to accept the provided replacement vehicle, the contract will be considered terminated under Daily, Weekly, and Monthly Subscription bookings. In the case of a leased vehicle under Micro Lease/Lease Pro, this will be treated as early termination, and standard termination charges will apply.

5. Accidents

In the event of any damage or accident involving the vehicle, the Hirer must contact the police before moving the vehicle. A police report and repair slip must be obtained. Failure to acquire these documents will result in the Hirer being responsible for all damages incurred. It is the Hirer's responsibility to secure these documents.

6. Traffic Violations & Tolls

All costs arising from fines, tolls, or other penalties imposed by traffic authorities during the rental period will be the Hirer's responsibility and will be recovered accordingly. The company reserves the right to charge the Hirer's credit card to cover these non-rental charges, and a notification email with supporting documents will be sent to the registered email ID. Additionally, a service charge of ₹5,000 or 15% (whichever is higher) will be applied to the total amount levied on top of the traffic fines or other penalties. Continuation of service in the event of failure to clear traffic fines is at the sole discretion of SelfDrive and/or its affiliate partners.

7. Fuel, Water, Oil & Tire Pressure

Only special or unleaded fuel should be used. An administration fee of 20% will be added to the refueling cost. The Hirer is responsible for regularly checking and maintaining the water and oil levels, as well as tire pressure, to ensure they are within the acceptable range for the vehicle type. Any damage or puncture to the tires will be charged to the Hirer, who is authorized to replace the tire only with OEM brand, make, and specifications. Any deviations noted at the time of vehicle return will result in charges as invoiced by the partner.

8. Vehicle Condition & Tinting Glass

The Hirer must maintain the hired vehicle in a clean, safe, and sound condition to avoid additional cleaning charges upon vehicle return. Tinting the vehicle's windows is strictly prohibited; violators will incur a fine of ₹5,00,000, and will be held responsible for any related penalties.

9. Vehicle check-in

The Hirer must notify SelfDrive or its associated partners of their intention to return the vehicle at a different location prior to the return, specifying the date and time; otherwise, excess days' charges will be applied. Any change in the return location, differing from the one selected at the start of the rental, will incur an additional service charge. At the time of the vehicle's return, any unreported damage, as well as damages without police reports, will be charged in full to the Hirer's account.

10. Driving License

1. A valid UK driving license is mandatory for all residents. Tourists and visitors must present an international driving license along with their home country license

2. A valid Indian driving license is mandatory for all residents, while tourists and visitors must possess an International Driving Permit (IDP) in addition to their home country driving license.

11. Payment & Deposit

  1. Upon successful booking, an e-ticket will be sent to your registered email address, and an SMS will be sent to your registered mobile number as payment confirmation. Payment terms are agreed upon at the time of rental, where credit and debit card payments are accepted. Rental charges must be paid in advance, and a pre-authorization/charge for a security deposit is required to confirm the booking.
  2. The hirer must be the holder of the credit/debit card used for the transaction and must be present at the time of collection at the rental counter or upon delivery to execute the rental agreement. Failure to adhere to the cardholder policy may result in the cancellation of the reservation, with a 10% cancellation fee applied to the total invoice value. Any remaining balance will be transferred as "SelfDrive credits," which can be claimed by logging into the SelfDrive mobile application.
  3. The hirer must have an adequate credit limit to cover a minimum deposit ranging from ₹25,000 to ₹2,50,000, depending on the vehicle model rented. The deposit will be a pre-authorization charge on the hirer's credit/debit card and is intended to cover potential traffic fines and minor vehicle damages up to the cost of repair.
  4. Late Payment Charges: In the event of non-receipt of payment for extension of a reservation, a late payment charge of ₹20,000 per month will apply to all late payment invoices.
  5. In case of payment default or failure, SelfDrive reserves the right to implement measures leading to the immobilization of the vehicle to recover the outstanding amount, with prior notice. The remobilization fee will be ₹7,500.
  6. The hirer authorizes SelfDrive to seize and/or take steps to seize the rented vehicle in case of a breach of contract and acknowledges that representatives have full authority to retrieve the vehicle.

12. Booking Extension

An automatic extension will occur for all rentals—daily, weekly, or monthly—on the rental expiry date as per the e-ticket billing cycle. It is the hirer's responsibility to notify the SelfDrive team via the "Return" tab in the mobile app at least 24 hours before the rental expires. No claims will be processed after the invoice is generated from the auto extension, and no refunds will be accepted thereafter.

The hirer must ensure communication with SelfDrive at least 24 hours prior to the end of the rental period to extend or return the vehicle. Failure to do so will result in an automatic extension of the rental as per the original booking duration and type. No refunds will be processed once the auto extension is activated.

13. Offers

All offers are valid for first-time reservations only, and the same rates will not apply for extensions. Offers are limited to specific car models and durations. SelfDrive reserves the right to modify or terminate any offer without prior notice. Extensions will revert to new rates post-offer end, except for bookings under the monthly category processed with prior agreements.

  1. Down Payment processed under this offer is non-refundable.
  2. No refunds for early return or cancellation of bookings processed under this down payment offer.
  3. This offer cannot be combined with any other promotions (coupon codes, tactical sales, etc.).
  4. Standard rental terms apply to all other conditions.
  5. Offer is subject to availability and may be terminated by SelfDrive without prior notice.

14. Zero Deposit Offer

Booking Cancellation

  1. This limited-time offer applies to selected car models and is exclusively for debit and credit card holders. Cardholders must maintain sufficient credit limits to cover damages, fines, tolls, penalties, and other potential losses. Failure to do so will be considered a breach of contract.
  2. Minimum liability will be the security deposit amount specified prior to booking. In case of reported damage, SelfDrive reserves the right to charge the cardholder a minimum of ₹50,000 up to the actual damage cost.
  3. The cardholder authorizes SelfDrive to charge the card for any damages or losses incurred. The cardholder also agrees not to file chargeback claims related to the Zero Deposit Offer. If a customer wishes to opt-out of this offer, they must contact SelfDrive within 24 hours of booking.
  4. All standard terms and conditions apply as per the rental agreement.

15. Cancellation Policy

  1. All cancellations must be processed through the authorized SelfDrive call center. Refunds for reservations will be issued if cancellations are requested within 7 days of the initial booking before vehicle pickup. A flat 10% cancellation fee will apply for cancellations due to non-compliance with required documentation.
  2. Refunds will be processed only through the original mode of payment and may take up to 45 days for completion.

16. No Shows/Lost Rentals: Prepaid Reservations (Pay Online)

If you fail to cancel your reservation prior to the Pick-Up Time and do not collect the vehicle on the Pick-Up Date, or if you fail to comply with the pick-up terms (refer to Rental Qualifications & Requirements), we reserve the right to apply a No Show/Lost Rental Charge equivalent to the full rental amount. If no communication is received from the Hirer's end within 12 hours of the pick-up time regarding any changes to the reservation, a charge of 100% of the rental will be applied.

17. Early Return

Rental refunds are not applicable in the event of an early return of the vehicle. Refunds of down payments are also not applicable for early returns under subscription offers.

18. Late Return Charge

Hirers are expected to return the vehicle at the same time specified on the vehicle checkout form signed at the time of vehicle pickup. A buffer time of 1 hour will be permitted from the actual return time. Any delay beyond this will result in a Late Return fee of a minimum of ₹5,000 to a maximum of ₹100,000, or a minimum charge of 1 day's rental plus ₹20,000 administrative fees. This fee is to compensate for the costs incurred in finding an alternative vehicle for the next booking and for administrative costs in contacting you regarding the vehicle's return.

19. Refund

All refund claims must be pre-approved by the company. All relevant details, including the E-ticket and Reservation Copy, must be emailed to accounts@selfdrive.in. Refunds will be processed to the Hirer's card using the original mode of payment only. All claims and refund requests must be submitted within 60 days from the date of reservation or payment. All deposit refunds will be processed within 30 days, contingent upon receiving full clearance from supply partners and relevant government authorities regarding any traffic fines.

20. Terminations - Micro Lease / Lease PRO / Neos

All reservations for 3-month, 6-month, or 12-month terms are subject to an early termination penalty of 2 months' rental charges if returned early or if the contract is closed early. No refunds will be processed for early termination of Daily, Weekly, or Monthly reservations.

21. Indemnification

Without limiting the generality or effect of other provisions of this Agreement, you agree to indemnify, hold harmless, and defend us, our affiliates, licensees, subcontractors, and agents, and each of our or their officers, directors, and employees, from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), or other expenses that arise directly or indirectly out of or from your breach or alleged breach of this Agreement/any clause or part, including any violation of the Code of Conduct above; and (b) your use of this website and engagement in transactions on this website including, but not limited to, use of the Site Materials.

22. Delivery / Collection of Vehicles

Delivery and collection of vehicles are chargeable and vary according to location, with a minimum charge of ₹5,000 each way.
Prior to returning the vehicle (actual rented car or replacement car), the customer must ensure that the vehicle is clean, free from all personal belongings and waste materials, and returned with the same fuel level as received.
If the returned vehicle contains customer belongings, they will be kept in the lost and found department. The customer is responsible for collecting their belongings within 15 days from the date of retrieval. Henceforth, the company and its suppliers do not stand liable for any losses incurred from the same and will not accept any compensation claims.

23. Airport Surcharge

All airport parking charges are the responsibility of the hirer. If SelfDrive pays these charges on behalf of the hirer, an additional ₹2,500 (minimum) surcharge will apply.

24. Breakdown Service

The hirer will have to contact the service partner through the number mentioned in the SelfDrive mobile application after logging into the profile or through the number mentioned in the e-ticket.

25. Additional Charges

Additional charges shall apply to the hirer for any tollgate passing as well as for any other additional requirements of the hirer as per the law. It is the responsibility of the hirer to carry a baby seat as mandated by the concerned traffic authorities. Any fines regarding the same will be charged to the renter's account.

26. Driving Outside the Permitted Zone & Off-Road Driving

Our vehicles are not permitted to be used for safari, fun drives, racing, off-roading, advertising, hiring, leasing, subleasing, contracting, third-party contracting, mobility services, loans, or use for loan security or financial rewards. The hirer will be held liable to pay all damages, necessary repairs, and towing charges if they fail to adhere to the same.
In general, the rental vehicle may only be used in the state of pickup and the surrounding geographical area (region) as approved and accepted by the law of the land.

27. Usage of Vehicles

  1. The hirer commits and agrees that they won't allow anybody to drive the rented vehicle unless authorized by SelfDrive.
  2. The hirer undertakes that neither they nor any listed additional drivers will use the vehicle for pushing, pulling, or towing objects, races, fun drives, on rough roads or desert safaris, teaching driving, or renting the vehicle without SelfDrive's permission. Hirers that fail to adhere to these terms will be held responsible and liable for all charges resulting from damages, penalties, fines, and other dues. The hirer commits that they or any additional driver will not drive the vehicle outside the permitted zone.
  3. Smoking, including the use of electronic smoking devices, is not permitted in any of the SelfDrive cars.
  4. The hirer agrees to disclose the location of the vehicle upon request and allow the company or its representatives to inspect the vehicle at all reasonable times, permitting entry into any land or premises where the vehicle is located or stored.

28. Minors Not Allowed to Be Users

Use of the website and services for booking, rental, or driving of SelfDrive is available only to persons who are above the age of 24 years and below 65 years, and can form a legally binding contract under local law. If you are a minor (i.e., under the age of majority specified by law), you may use https://www.selfdrive only through a parent or guardian but are not permitted to subscribe to the services yourself by using the website.

29. Currency for Payment

We will accept the following currency towards payment: INR only.

30. Compliance with Sanctions

We expressly state that we do not trade with or provide services in or to OFAC and sanctioned countries.

31. Transaction Records

The Hirer must maintain a copy of transaction records and other relevant policies and rules pertaining to their rental agreement.

32. Contract - Commercial Terms & Conditions

All commercial terms will be as per the agreed terms with SelfDrive India, which will prevail over all other agreements, contracts, or terms.

33. Compensation

SelfDrive India and its associated partners retain full discretion to offer any compensation deemed appropriate in any situation. Situations will be assessed based on proper documentation (circumstantial or objective). Any details regarding compensation, if applicable, will be communicated to the renter within 7 working days.

34. Disclaimers

  1. The information provided on this website is for general informational purposes only. While we endeavor to keep the information up to date and correct, all site materials and any product or service obtained through or in connection with this website are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, either express or implied, regarding the completeness, accuracy, reliability, suitability, or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose, unless otherwise expressly provided in a written agreement with us concerning a specific product or service.
  2. By Using or continuing to use the site you agree to use of your information (Including Sensitive Personal Information) in accordance with the Terms & Conditions of Selfdrive which may be amended from time to time as per the legal requirement of the Operational domicile. You also agree and consent to us collecting, storing, processing, transferring and sharing information (Including Sensitive personal information) related to you with third parties or service providers to execute the services, including payments/details for the period of the service that you have opted with Selfdrive in the operational domicile.
  8. In the event of a conflict arising between any information posted on this website, this Agreement, and/or any contract you have with us, the terms of your contract with us will prevail over this Agreement and the information posted on this website, and this Agreement will prevail over information posted on this website.

35. Limitation of Liability

As a condition of your use of this website, you agree that neither we, nor any of our affiliates, licensees, suppliers, directors, officers, shareholders, employees, or agents, shall be liable to you, anyone claiming on your behalf, or any third party for any direct, indirect, incidental, special, exemplary, punitive, or other damages, including but not limited to:

  1. Loss of profits, loss of earnings, loss of business opportunities, lost data, or interrupted communications.
  2. Damages arising from your reliance on this website or any information or materials found on this website, or hyperlinked from this website.
  3. Mistakes, omissions, interruptions, errors, defects, delays in operation, transmissions, eavesdropping by third parties, or any failure of performance of this website.

Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms and Conditions due to circumstances beyond our reasonable control, including but not limited to government restrictions, strikes, war, civil commotion, terrorist activities, natural disasters, power failures, large increases in online activity, viruses, catastrophic hardware failures, fires, floods, or unusually severe weather.

Security of Information
We do not guarantee the security of information you provide in connection with your use of this website. Unauthorized third parties may intercept such information.

Vehicle Liability
In no event will the company or its suppliers be liable for any loss or damage incurred by the Hirer, including but not limited to:
Fair wear and tear of the vehicle.

  1. Any loss arising out of, any delay in or failure to effect delivery of the vehicle or any damage incurred in the course of delivery.
  2. Loss or damage that is not reasonably foreseeable to the Hirer.

Dissatisfaction
Your sole remedy for dissatisfaction with this website or its materials is to stop using it. Your continued use of this website signifies that you have read, understood, and accepted these Terms and Conditions.

Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in India.

Account Responsibility
If you use a COMPANY site, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

Payment Terms
We accept online payments using Visa and Mastercard credit/debit cards in INR or any other currency agreed upon.

36. Availability of this Website

This website is usually available 24 hours a day, 7 days a week. However, we reserve the right to make the website unavailable at any time for any reason. We shall not be liable for any damages arising from any interruption, suspension, or termination of this website.
